Graphic Design:

Quotations:


Quotations issued by WebNavic for work are valid for up to 14 days. After 14 days have elapsed, WebNavic reserves the right to alter or decline the quotation.


Project design proposal:


WebNavic will send the client a design proposal together with the quotation. The client acknowledges that by accepting the quotation and agreeing to the design proposal, they are bound by these terms and conditions.


Timeframes for Projects:


Any timeframes that WebNavic provides to the client are approximate and reasonable. Whilst WebNavic endeavours to complete each project within the timeframe specified in the design proposal, WebNavic shall not be held liable for any unforeseen delays in the completion of the project.


Client engagement:


WebNavic expects clients to respond to requests for feedback, approval, sign-off and information within 5 business days unless a longer timeframe is agreed between WebNavic and the client. This is to ensure that the project progresses smoothly.


If a client takes longer that 30 days to respond, WebNavic may place the project on hold or cancel the project in accordance with the cancellation clause below.


Graphic design concepts:


WebNavic will design graphic design concepts and provide them for review by the client by electronic mail.


Additional revisions:


One additional round of revision to the graphic design concepts will be provided free of charge. Further revisions will attract an hourly charge which will be specified in the design proposal.


Corrections by the client:


Any corrections by the client that is outside the provided content will be charged at an hourly rate that will be specified in the design proposal. To avoid corrections by the client, please ensure that all content is approved before sending it through.


Delivery of the graphic design:


The completed graphic design files will be sent to you as digital files via electronic mail.


Intellectual property:


Intellectual property in the graphic design will be transferred to the client once the project payment is paid in full.


If the project is cancelled for any reason by the client, the client acknowledges that WebNavic retains intellectual property rights in the graphic design and may reuse the design for another project. The client also forfeits all concept designs that were made up and until the project cancellation.


WebNavic retains the right to use the graphic design for business promotional purposes including social media.


The client assumes responsibility to protect the graphic design produced and handed over by WebNavic by either copyright or a trademark.


Payment structure for work performed:


For all graphic design project work performed, the client agrees to pay WebNavic 100% of the project cost in full. All payments are due within 7 days of the date of the invoice.


Cancellation of the project:


If the client cancels the project after it has started, the client will forfeit any payments made up and until the cancellation.


If WebNavic cancels the project after it has started, the client will only pay for the produced work that it intends to use.


Non-Disclosure clause:


WebNavic agrees that neither it nor any persons contracted to work on the project shall disclose any confidential information about the project to a third party.


Subcontracting clause:


WebNavic may at its discretion subcontract some of the work as it sees fit in order to complete the project work.

Logo design concepts:


WebNavic will design logo concepts and provide them for the client’s review by electronic mail. Based on the client’s feedback, WebNavic will make changes to the logo concepts until the client is satisfied.


Additional revisions:


One additional round of revision to the logo concept will be provided free of charge if the client is not satisfied with the initial logo concepts. Further revisions will attract an hourly charge which will be specified in the design proposal.


Corrections by the client:


Any corrections by the client – for example – due to the client’s business changing its name, will be charged at an hourly rate that will be specified in the design proposal.


Delivery of the logos:


The completed logo design files will be sent to you as digital files through electronic mail.


Intellectual property:


Intellectual property in the logo design will be transferred to the client once the project payment is paid in full.


If the project is cancelled for any reason by the client, the client acknowledges that WebNavic retains intellectual property rights in the logo design and may complete, exhibit and sell the logo design. The client also forfeits all concept designs that were made up and until the project cancellation.


WebNavic retains the right to use the final logo or any version of the logo used to produce the final logo, in its portfolio page, social media and advertisements in order to promote its services.


The client assumes responsibility to protect the logo design produced and handed over by WebNavic by either copyright or a trademark.

Website Design:

Payment structure for work performed:

For all project work performed, a 50% deposit is required prior to commencement of any project work. The client acknowledges that payment of the deposit constitutes commencement of the project. The final 50% payment is due upon completion of the project. All payments are due within 7 days of the date of the invoice.

Timeframes for Projects:

Any timeframes that WebNavic provides to the client are approximate and reasonable. Whilst WebNavic endeavours to complete each project within the timeframe specified in the design proposal, WebNavic shall not be held liable for any unforeseen delays in the completion of the project.

Changes to the design:

Once the initial design has been approved by the client, WebNavic reserves the right to charge the client at an hourly rate for any major changes to the design. The rate that the client will be charged will be stipulated in the design proposal.

Non-Disclosure clause:

WebNavic agrees that neither it nor any persons contracted to work on the project shall disclose any confidential information about the project to a third party.

Subcontracting clause:‍

WebNavic may at its discretion subcontract some of the work as it sees fit in order to complete the project work.

‍Cancellation of the project:

If the client cancels the project after it has started the client will forfeit any payments paid up until the project cancellation even if the client doesn’t intend to use the produced work.

If WebNavic cancels the project after it has started the client will only pay for the produced work it intends to use.

No refunds will be given for change of mind.

WebNavic reserves the right to cancel the project or refuse a client its services if WebNavic receives communication which is abusive, threatening or disrespectful.

Supply of wording for the website:

The client is responsible for providing the appropriate text for each page of the website. WebNavic may make changes to the website text in consultation with the client as part of the website design. If the client requires the engagement of a copywriter in order to supply text for the website, WebNavic will supply the client with a separate quotation for the copywriting work and in accordance with the subcontracting clause above, engage the copywriter to perform the writing work.

Intellectual Property:

The intellectual property that exists in the created work will be transferred to the client once WebNavic has completed the project and has been paid in full.

WebNavic reserves the right to include the client’s website in its portfolio page and to promote its services by including a screenshot and link to the client’s website on its social media pages.

It is the client’s responsibility to ensure that they have sought the required permissions for all wording, images, logos, trademarks and other media that the client has agreed to supply to WebNavic for the project. The client agrees to indemnify WebNavic from all legal claims and actions in relation to media supplied by the client.

Search Engine Optimisation:

WebNavic provides basic search engine optimisation as part of the website design project, and this is governed by best practice. WebNavic does not and cannot guarantee any specific search engine positioning of your website as this is beyond WebNavic’s control.

Website Hosting:

Websites designed by WebNavic are hosted on Wix Studio's hosting platform and Wix is responsible for maintenance of the website, software updates, security patches and maintenance of the hosting infrastructure. WebNavic does not provide extensive IT support. WebNavic’s support is limited to the design and maintenance of the website content only.

Email Addresses and accounts:

WebNavic doesn’t host or provide email addresses and accounts. The client is responsible for the set up and provision of any e-mail addresses that will appear on their website. WebNavic recommends Google Workspace or Microsoft 365 email for its clients.
